Guidelines for Use of Trademarks and IP

This statement is formally issued by Beijing IST Technology Development Co., Ltd., the brand operator of ISTINST (hereinafter referred to as “we,” “us,” or “our”), as a global public legal declaration concerning the ownership of the ISTINST trademark, usage regulations, infringement liability, and matters pertaining to the trademark rights of the products we represent. This statement applies to all natural persons, legal entities, and other organizations worldwide who access our official independent website (www.istinst.com), engage in commercial cooperation with us, or interact with our products and services.

I. Exclusive Statement on Ownership of the Registered ISTINST Trademark

1. We are the sole and lawful global owner of the “ISTINST” trademark (hereinafter collectively referred to as the “ISTINST Trademark”). We legally hold all exclusive trademark rights, including the exclusive right to use, license, transfer, and enforce the trademark, which are strictly protected under the intellectual property laws and regulations of the People’s Republic of China, including the Trademark Law.

2. The ISTINST trademark has been registered with the trademark authority of the State Intellectual Property Office of the People’s Republic of China. The approved goods and services cover International Classes 9 and 35 (core coverage includes: precision measuring instruments, surveying and mapping instruments, geological exploration and analysis instruments, material testing instruments and machines, optical apparatus and instruments, electronic measuring equipment, measuring instruments, concrete testing machines, electromagnetic measuring detectors, measuring instruments and apparatus, and other related registered categories). All trademarks are valid and in full force and effect.

3. Without our formal written authorization, no entity or individual may use any identical or similar mark to the ISTINST trademark on identical or similar goods or services, nor undertake any acts that dilute or infringe upon our exclusive trademark rights. The ISTINST trademark must not be used in any commercial context, including business names, domain name registrations, e-commerce stores, or social media accounts.

II. Compliance Statement for Products Sold Under Agency AgreementRegarding third-party branded products officially sold under our agency agreements, we hereby make the following compliance statement concerning trademark matters:

1. As an officially authorized agent and special distributor for multiple globally renowned equipment brands, we have obtained formal, lawful trademark usage authorization and product distribution authorization from the respective brand owners. Complete authorization documents are available for verification upon customer request.

2. All intellectual property rights—including trademarks, brand logos, patents, and copyrights—associated with the brands we distribute belong entirely to the original brand owners. Our use of such trademarks is strictly confined to the geographic scope, product categories, usage scenarios, and authorized timeframe specified in the brand owner’s written authorization. Such use is solely for the lawful commercial promotion, product sales, and supporting technical services of genuine factory-direct products from the brand. We do not engage in any trademark usage beyond the authorized scope and never tamper with or misuse the trademark logos of represented brands.
3. We solemnly pledge that all represented brand products are sourced directly from the brand manufacturer with fully documented and authentic supply chains, and we resolutely eliminate counterfeit or imitation products. Any products bearing the corresponding brand trademarks sold through channels other than our official channels or the brand manufacturer’s authorized channels are unrelated to us. We assume no warranty, technical support, or related legal liability for such products and reserve the right to report counterfeit sales and trademark infringement activities while assisting brand owners in enforcing their rights.
4. We strictly adhere to global trademark laws and regulations as well as brand owners’ authorization management standards. We resolutely oppose illegal activities including trademark infringement, counterfeiting, and unfair competition, and are fully committed to safeguarding the legitimate rights and interests of represented brands and our customers.

III. Declaration on Defining Trademark Infringement and Enforcement of Rights

We maintain a zero-tolerance stance toward trademark infringement and counterfeiting worldwide. We hereby formally define infringing acts and publicly announce our enforcement measures:
(一) Definition of Trademark Infringement
Any entity or individual engaging in any of the following acts without formal written authorization from us or the relevant brand owner constitutes trademark infringement and unfair competition:
1. Using identical or highly similar text, graphics, or combined logos to the ISTINST trademark on identical or similar goods or services, sufficient to cause confusion or misidentification among relevant global audiences and customers;
2. Unauthorized use of the ISTINST trademark, our company name, or agency brand trademarks in any commercial context, including product packaging, promotional materials, e-commerce stores, independent website pages, social media accounts, domain registrations, or overseas business name registrations;
3. Production, sale, storage, transportation, import, or export of products bearing counterfeit ISTINST trademarks or agency brand trademarks, or copying the appearance, packaging, manuals, or technical documentation of our products;
4. Falsely claiming official authorization from, strategic partnerships with, or corporate affiliations to our company, the ISTINST brand, or our represented brands to mislead the public and customers;
5. Providing storage, logistics, promotion, platform operation, or other facilitation for the above infringements, which constitutes contributory infringement and shall result in joint and several liability.
(二) Enforcement and Accountability Measures
We have established a global intellectual property protection and cross-border enforcement system, maintaining long-term collaborations with multiple international IP law firms, cross-border enforcement agencies, and platform compliance departments. For any trademark infringement, we will immediately initiate comprehensive enforcement procedures, including but not limited to the following measures:
1. Issuing formal attorney letters and cross-border infringement warning notices to infringers, demanding immediate cessation of all infringing activities, public apology, and elimination of adverse impacts;
2. Filing infringement complaints with major global e-commerce platforms, search engines, social media platforms, and domain name registrars, demanding removal of infringing content, suspension of infringing accounts, and cancellation of maliciously registered domains;
3. Submitting infringement reports to the trademark authorities, market regulatory agencies, and customs intellectual property protection departments in the jurisdiction where the infringement occurred, requesting administrative investigation and the lawful seizure of infringing goods in transit;
4. Initiating civil litigation before local judicial authorities or commercial arbitration in accordance with the trademark laws and regulations of the jurisdiction where the infringement occurred and international intellectual property conventions, demanding that the infringing party bear legal responsibility for ceasing infringement and compensating us for all economic losses (including brand damage, enforcement costs, customer loss, and other related damages);
5. For severe cases involving counterfeiting registered trademarks or selling counterfeit trademarked goods that constitute criminal offenses, we will report to public security authorities in accordance with the law and resolutely pursue criminal liability against infringers.

IV. Authorized Use Guidelines and Disclaimer

1. Authorized Usage Guidelines: Only distributors and partners holding our formal written authorization may use the ISTINST trademark within the scope, duration, and geographic area explicitly stipulated in the authorization document. During use, the trademark logo style must not be altered without permission, usage must not exceed authorized categories and scenarios, and sublicensing to third parties is prohibited. Upon termination or expiration of the authorization agreement, all related trademark usage must cease immediately. Any unauthorized use constitutes trademark infringement, and we will pursue legal action accordingly.
2. Disclaimer:
– Any third party using the ISTINST trademark or agency brand trademarks without our authorization shall bear full legal responsibility for such actions. We assume no joint liability arising from such unauthorized use.
– We provide no product warranty, technical support, or after-sales service for any products bearing the ISTINST trademark or agency brand trademarks purchased through non-official authorized channels. We shall not be held liable for any quality issues, economic losses, or legal disputes arising from such products.
– This statement does not constitute implied permission, authorization, or waiver of rights regarding any trademark usage. We reserve the right to pursue legal action against trademark infringement at all times.

V. Infringement Reporting and Compliance Consultation

To uphold a fair and orderly market environment and protect the legitimate rights and interests of our brand and global customers, we have established a global infringement reporting channel. We welcome reports from all sectors of society and our customers regarding trademark infringement, counterfeiting, and unfair competition practices, whether submitted under real names or anonymously. We will strictly maintain the confidentiality of all reported information and promptly address verified infringements.

We hereby solemnly declare that all relevant entities and individuals worldwide must strictly comply with international intellectual property conventions and applicable trademark laws and regulations of their respective countries and regions. Adherence to this declaration is required for honest and compliant business operations. We reserve the final right to interpret and update this declaration, with any revisions taking effect upon publication.
